 Police investigation and their Coercing Witnesses

 

Darrell Lee Clark (Clark) and his friend Cain Joshua Storey (Storey) were 17 years old when they were arrested for their alleged involvement in the death of their friend a 15-year-old Braian Bowling (Bowling).

 

Bowling died from a gunshot wound to the head in his home in 1996. Moments before the gun was fired, Bowling was on the phone with his girlfriend and told her he was playing a game with a gun, which was brought to his home by his friend Storey, who was in the room at the time of the shooting.

 

Storey was charged with involuntary manslaughter. But a months later, police began investigating the death as homicide, on the statements of two witnesses and the urging of the deceased Bowling’s family members.

 

The two teenagers were sentenced to life in prison after being convicted of murder and conspiracy to commit murder, following the weeklong trial in 1998.

 

Actually, what happened was - Bowling accidentally shot himself in the head. 

 

But the first witness, a woman who live near Bowling’s home, was interviewed by police, who claimed the teens confessed they had ‘planned the murder of Bowling because he knew too much about a prior theft Storey and Clark had committed.

 

Based on this witness statement, Storey was charged with murder and Clark was arrested as a co-conspirator, despite having a corroborated alibi of Clark, stating he was his home on the night of the shooting, which was supported by his two witnesses.

 

After 25 years – now that woman witness revealed in the podcast that police coerced her into giving false statements and threatened to take her children away from her if she failed to comply.

 

The other witness, a man who was in a different room of the (deceased) Bowling’s home at the time of the shooting, identified Clark from a photo lineup as the person he saw running through the yard on that night.

 

Later on – now the man-witness revealed in the podcast that his testimony was based on an ‘unrelated, factually similar shooting’ which he witnessed in 1976 and he stated that he never identified Clark as the individual in the yard, nor did he ever witness anyone in the yard on that night.

 

New Trial

 

NOW based on the two witnesses’ re-statements, New-Trial was ordered on the fresh pleadings challenge a wrongful conviction.

 

Clark now 43 was released from the Floyd County Jail after the Floyd County Superior Court Judge John Neidrach agreed the conviction should be overturned and all underlying charges against him dismissed, after evidence in the case was reexamined.

 

Story admitted to bringing the gun to Bowling’s home, was also released after accepting a plea deal for involuntary manslaughter. A 10-year sentence with time served, after spending 25 years in prison. He was also exonerated of murder charges.

 

Feeling of Storey

Storey told “He was afraid to go to sleep the first night after he was released and in case he would up and “realize it was all a dream”.

 

Feeling of Clark

Clark told “Never would I have thought I would spend more than half my life in prison, especially for something I didn’t do”.

 

Feeling of Clark’s dad

Clark’s father told “I watched my son go into prison as a kid, I watched him go through prison, I watched him come out as a man.”

 

Judge apologized

The New Trial Judge, Floyd County Superior Court Judge John Neidrach apologized on behalf of the State of Georgia and Floyd County during the court hearing. Clark said it was an important step towards healing.

 

After 25 years of wrongful imprisonment, 2 Georgia men set free after newly uncovered evidence exonerates them of murder charges.

 Shariat law vs Customary law

 

The "Muslim Personal Law (Sheriath) Application Act 1937. (Act 26 of 1937)

 

The book titled "Muslim Law of Marriages and Succession in India" by Justice S.A.Khader.

 

The Author has stated various custom and usage prevalent in certain sections of the Muslims living in different parts of this country.

 

The Indian legislature untouched the personal or family laws relating to succession intestate and testamentary, marriage, dissolution of marriage and the like of the Mohammadden.

 

Various customary practice

So far as the Muslims were concerned, various customary practices followed by some sects of the Muslim.

 

They are:

(i) Mappillas of North Malabar, 

(ii) Cutchi Memons, 

(iii) Khojas, 

(iv) Sunni Boharas of Gujarat, 

(v) Molesalam Giarasias of Breach, and 

(vi) Halai Memon of Probandar (Gujarat).

 

Mappillas of North Malabar:

 

Mappillas of North Malabar were governed in the matters of inheritance by the Marumakkathayam system of matriarchal succession unknown to Muslim Law.

 

The Mapilla Succession Act, 1918 (Act 1 of 1980) passed by the Legislature of the then Madras Presidency which prescribed that notwithstanding any custom to the contrary, the separate property of such a Mappilla shall devolve upon his heirs in the order and according to the rules of Muslim Law.

 

The Malabar Wills Act, 1898 found that those Mappillas were entitled to dispose of their separate property in entirety by will, while under the Shariat, a Muslim can dispose of by will only one-third of his estate.

 

The Mappilla Wills Act 1928 extended to the Mappilla Muslims.

 

The Shariat Law has come into effect from 1.1.1929.

 

Neither the Mappilla Succession Act, 1918 nor Mappilla Wills Act, 1928 affects the Tarward property, unless the Mappilla concerned was exclusively entitled to it.

 

The Muslim Personal Law (Shariat) Application Act, 1937 (Act 26 of 1937) also does not touch or affect the rights and incidents of the Mappilla Marumakkathayam tarward, where property devolved by survivorship, a concept quite foreign to the Shariat.

 

Based on rulings reported in Abdul Rahim v. Avooma, AIR 1956 Mad. 1441, in Mohammed Sandhu Khan v. Rathnam, AIR 1956 Mad. 144 apart from Full Bench judgment of Kerala High Court reported in Laxman v. Kamal, that the Mappilla Marumakkathayam Act (Madras Act 17 of 1939) only dealt with the management of the Tarward, the duties of the Karnavan and the rights of the junior members and does not abolish the system which still continues.

 

Cutchi Memons, Khojas, Sunni Bohras etc

The Act concerning certain other sects such as Cutchi Memons, Khojas, Sunni Bohras of Gujarat, Molesalam Giarasias of Broach, and Halai Memon of Probandar (Gujarat), is the Shariat Act 26 of 1937.

 

Customary law should in no case take the place of Muslim Personal Law.

 

Customary Law is a misnomer inasmuch as it has not any sound basis to stand upon and is very much liable to frequent changes.

Customary law cannot be expected to attain at any time in the future that certainty and definiteness which must be the characteristic of all laws.

 

Tamilnadu Act on Shariat law:

So far as the State of Tamil Nadu was concerned, by Tamil Nadu Act, Section 2 of the Parent Act (Shariat law 1937) was substituted and the substituted Section 2 reads as under:

 

"Notwithstanding any custom or usage to the contrary in all questions regarding intestate succession, special property of females, including personal property inherited or obtained under contract or gift or any other provision of Personal law, marriage, dissolution of marriage, including talaq, ila, zihar, lian, khula and mubarrat, maintenance dower, guardianship, gifts, trusts and trust properties, and wakfs, the rule of decision in cases where the parties are Muslims shall be the Muslim Personal Law (Shariat)"

 

Purpose of Shariat law

The whole purpose of the enactment of parent Shariat law and Tamilnadu Amendment, was to rule out any possibility of customary law taking the place of Muslim Personal Law.

 

The purport of the enactment is that the application of Muslim Personal Law was the rule and anybody's attempt to go by any custom or usage was considered as an exception.

 

Only under certain stated circumstances where the enforcement of any customary usage or practice was attempted to be tinkered with in certain sects such as in the case of Mappillas, Kozas, etc.

 

Unless a declaration (for a custom or usage) is made under section 3, of Shariat law, there is no scope for application of the Muslim Personal Law.

Divorce petition within one year of marriage:
Statutes such as Section 29 of the Special Marriage Act and Section 14 of the Hindu Marriage Act, which enabled the Courts to entertain the petition to be presented before one year had lapsed from the date of marriage.

Christian has to wait one year to file divorce petition:
No such provision had been incorporated in the Divorce Act 1869 (Christian Divorce Act).

Sec.10A of the Divorce Act, 1869
S.10A of the Divorce Act, 1869 provides a minimum of one year period to file divorce cases by Christians. There is no provision for filing such petition before the lapse of mandatory one year period in exceptional circumstances.

Kerala HC struck down S.10A 
Therefore this provision of 10A of the Divorce Act, 1869 was challenged before the Kerala High Court.

The Kerala High Court (the Division Bench comprising Justice A. Muhamed Mustque and Justice Shoba Annamma Eapen), on Friday 09 Dec, 2022 held that the fixation of the minimum period of separation of one year under Section 10A of the Divorce Act, 1869 is violative of the fundamental rights and struck it down. 

"No remedy is provided by statute in exceptional and depraved conditions for a spouse to approach the Courts to get rid of the minimum period.

This essentially ensures that efficacious judicial remedy is provided in cases of exceptional hardships to the parties. The denial of such a remedy to Christians."

Section 10 of the Divorce Act, provides the grounds for dissolution of marriage on fault basis.

By Amending the Act in 2001, Section 10A of the Act was inserted as a provision for dissolution of marriage by mutual consent.

New Commission 
The Union Government has decided not go by the report of the Ranganath Mishra Commission Report and has appointed a new Commission headed by Former CJI, Justice K.G. Balakrishnan to examine the issue.


A three-member Commission has been appointed in October, 2022 to examine the issue, whether Scheduled Caste status can be granted to Dalits who have converted to religions other than Sikhism and Buddhism.


Present position 
At present, as per the Constitution (Scheduled Castes) Order, 1950 only those who are Hindu, Sikh and Buddhist can be granted Scheduled Caste status. 


Initially it was only for Hindus, however, later by way of an amendment in 1956 Sikhs were added and in 1990 Buddhists were included in the list.


Justice Ranganath Misra commission:
A 2007 report submitted by National Commission for Religious and Linguistic Minorities, under the Chairpersonship of retired CJI Ranganath Misra had found merit for granting Scheduled Caste status to Dalit Christians.


PIL in Supreme Court 
In 2020, the Supreme Court had issued notice in a PIL filed by an organization named National Council of Dalit Christians (NCDC) seeking a direction to grant Scheduled Castes (SC) status to Dalit Christians.

Petition prayers
Change of religion can't change the social status of a person.

Notions of caste hierarchy were present within Christianity.

Persons of SC origins were kept socially and economically backward.

Nearly 16 million Christians of SC-origin were suffering due to this.

The Constitution (Scheduled Castes) Order,1950 issued in exercise of Article 341 (1) of the Constitution of India to be unconstitutional.

"No person who professes a religion different from Hinduism, Sikhism and Buddhism shall be deemed to be a member of a Scheduled Caste." 

Restricting the SC status only to persons following Hinduism, Sikhism and Buddhism is violative of Articles 14 and 15 of the Constitution. 

Dalit-origin persons following Sikhism and Buddhism were granted Scheduled Caste status only in 1956 and 1990 respectively, by amendments brought to the Presidential Order. 

If backwardness in these religions can be recognized under the Presidential Order, omitting Christians from its coverage is arbitrary and discriminatory.

The non-inclusion of "Christians" in paragraph(3) of the Constitution (Scheduled Castes) Order, 1950, along with Hinduism, Sikhism and Buddhism, is discriminatory and violative of Articles 14,15,16 and 25 of the Constitution of India.

Majority of India has a casteist mindset regardless of religion.

Petition further sought to allow and extend the Scheduled Castes status to Christians of Scheduled Castes Origin for availing the Indian constitutional provisions under Articles 16, 46, 330, 332, 335, 338,341,366-24 and for availing the legal remedy/ protection under Scheduled Castes and Scheduled Tribes (Prevention) of Atrocities Act,1989.

1961-ல் சென்னை ஐகோர்ட்டில் நடந்த வழக்கு.

ஒருவர், தனக்கு ஏற்கனவே ஒரு மனைவி உயிருடன் இருக்கும்போது, இன்னொரு பெண்ணைத் திருமணம் செய்து கொள்கிறார். அவர்களுக்குள் கருத்து வேறுபாடு ஏற்படுகிறது. இரண்டாவது மனைவி ஜீவனாம்சம் கேட்டு வழக்குப் போடுகிறார். 

அதை எதிர்பார்த்த கணவர், சிவில் கோர்ட்டில், அவருக்கும், 2-வது மனைவி என்று சொல்லப்படுவருக்கும் எந்த சட்டபூர்வ திருமணமும் நடக்கவில்லை என்று தீர்ப்புக் கேட்டு சிவில் வழக்குப் போடுகிறார்.

கீழ்கோர்ட், அவர் கேட்டபடி வழக்கை அவருக்கு சாதகமாக தீர்ப்புக் கொடுத்து விடுகிறது.

ஆனால், முதல் அப்பீல் கோர்ட்டில், அவரின் வழக்கை தள்ளுபடி ஆகி விட்டது. காரணம் - சட்ட முறைப்படி திருமணம் நடக்கவில்லை என்றாலும், இருவரும் கணவன் மனைவியாக வாழ்ந்திருக்கிறார்கள். கணவன், இந்த திருமணத்தை சட்டப்படி நடத்திக் கொள்ளவில்லை. அவரும் தவறி விட்டார். தன் தவறையே தனக்குச் சாதகமாக பயன்படுத்திக் கொள்ள முடியாது என்பதே சட்டவிதி. அதையே Pari delicto principle (பேரி டெலிக்டோ கொள்கை) என்று சட்டம் சொல்கிறது.

பேரி டெலிக்டோ (Pari delicto) என்ற வார்த்தை ஒரு லத்தீன் வார்த்தை. இதன்படி, இருவருமே தவறி இழைத்த நிலையில் இருக்கும் போது, அதில் ஒருவர் மட்டும் அந்த தவறை, தனக்குச் சாதகமாக ஆக்கிக் கொள்ள முடியாது என்பதே அதன் சாரம்.

இவர்கள் திருமணம் செய்து கொண்டதாக சொல்லும் காலத்தில், இருதார மணத் தடை சட்டம் 1949 நடைமுறையில் இருந்த காலம். அந்த சட்டத்தின்படி, முதல் மனைவி உயிருடன் இருக்கும் போது, மறு திருமணம் செய்ய முடியாது என்ற சட்டம் 1949-ல் கொண்டு வரப்பட்ட சட்டமாகும்.

பின்னர், 1955-ல் இந்து திருமணச் சட்டம் கொண்டு வரப்பட்டது. அந்த சட்டம் வந்த பின்னர் 1949 சட்டம் ரத்து ஆகி விட்டது. 1955 சட்டத்தின்படி, முதல் மனைவி உயிருடன் இருக்கும் போது, 2-வது மனைவியை திருமணம் செய்ய முடியாது. அப்படி செய்திருந்தால், அந்த திருமணம் சட்டப்படி செல்லாது என்கிறது 1955 இந்து திருமணச் சட்டம்.

இந்த தீர்ப்பை எதிர்த்து, அவர் ஐகோர்ட்டுக்கு அப்பீல் வருகிறார்.

(The HIndu Widows’ Remarriage Act XV of 1856).

கோவிந்த படையாச்சி என்பவர் சொத்தை விட்டு விட்டு இறந்து விடுகிறார். அவருக்கு ஒரு மனைவியும், ஒரு மகளும் உண்டு. இந்து கணவரின் சொத்தில் மனைவிக்கு ஆயுட்கால உரிமை உண்டு என்பதாலும், மகனும் இல்லை என்பதாலும், மனைவிக்கு அந்த சொத்துக் கிடைக்கிறது. ஆனால், அவள் அந்த சொத்தை வேறு ஒருவருக்கு கிரயத்துக்கு விற்று விடுகிறாள். பின்னர் சில காலம் கழித்து, வேறு ஒரு ஆடவரைத் திருமணம் செய்து கொள்கிறார். 

இப்போது, படையாச்சியின் மகள், “தந்தையின் சொத்தில், தாய்க்குப் பின்னர் தனக்கு கிடைக்க வேண்டிய சொத்துரிமை உள்ளது. ஆனால் அதை அவளின் தாய் விற்று விடுவதால், அந்த கிரயம் செல்லாது என்றும், தனக்கு உரிமை உள்ளது என்றும், தாய் வேறு திருமணம் செய்து கொண்டதால், அவளுக்கு கணவர் சொத்தி்ல் கிடைக்கும் உரிமையை இழந்து விடுகிறார் என்றும் சொல்லி, 1955-ல் சிவில் வழக்குப் போடுகிறார். 

அதை ஏற்றுக் கொண்ட முன்சீப் கோர்ட், மகளுக்கு சாதகமாகத் தீர்ப்பு வழங்குகிறது. சொத்தை கிரயம் வாங்கியவர் அந்த தீ்ர்ப்பை எதிர்த்து 1957-ல் மாவட்ட கோர்ட்டில் அப்பீல் செய்கிறார். அதுவும் கீழ்கோர்ட், தாய் கிரயம் செல்லாது என தீர்ப்பு கொடுத்தது சரியே என்றும், ஆனால், அவரின் தாய், மறு திருமணம் செய்தது Madras Act VI of 1949 படி செல்லாத திருமணம் என்றும் எனவே, மகள், அந்த சொத்தை திரும்ப கேட்க முடியாது என்றும் தீர்ப்புச் சொல்லி விட்டது.

அதை எதிர்த்து, மகள், சென்னை ஐகோர்ட்டுக்கு அப்பீல் செய்கிறார். ஆனால் இந்த வழக்கில், தாய், மறுதிருமணம் செய்த போது, அவளின் புதுக் கணவருக்கு ஏற்கனவே ஒரு மனைவி உயிருடன் இருக்கிறாள். எனவே 1949 சட்டப்படி, இந்த மறுதிருமணம் செல்லாது. 1856 சட்டமான விதவைகள் மறு திருமணச் சட்டம் என்பது சட்டபூர்வமாக நடந்த விதவைகள் திருமணம் மட்டுமே. இங்கு அவ்வாறு நடக்கவில்லை. 

எனவே, மகள் அவளின் சொத்துரிமையை கேட்க முடியாது என்று சென்னை ஐகோரட் தீர்ப்பு சொல்லி விட்டது.

கச்சிமேமன், கோஸா முகமதியர் வழக்கம்:

கச்சி மேமன் என்பவர்கள் கட்ச் பகுதியில் வசித்த இந்துக்கள். இவர்கள் பல காலங்களுக்கு முன்னரே முகமதிய மதத்துக்கு மாறி விட்டார்கள். இருந்தாலும், பழைய இந்து பழக்க வழக்கங்கள் சிலவற்றைப் பின்பற்றி வருகின்றனர். இதில் சொத்தில் உரிமை கோருவது இந்து வழக்கப்படியே இருப்பதாக சொல்கிறார்கள். அப்படியென்றால், அவர்கள் இந்து கூட்டு குடும்ப முறைப்படி சொத்தை அடைய முடியுமா என்ற சட்டக் கேள்வி 1920-ல் சென்னை உயர் நீதி மன்றத்தில் ஒரு வழக்கில் ஏற்படுகிறது.

(O.S.) 100 at p.105. இந்த வழக்கின் முடிவு 1847ல் சொல்லப்பட்டது. அதில் கோசாஸ், மற்றும் கச்சி மேமன் முகமதியர்களின் சொத்தின் வாரிசு உரிமைகளில், முகமதிய சட்டத்திலும் மாறுபட்டு உள்ளது என்பது ஒப்புக் கொள்ளப்பட்டது.

 Sir Erskine Perry C.J. என்ற தலைமை நீதிபதி தனது தீர்ப்பில், கச்சி மேனன் மக்களில், இந்துக்களைப் போலவே, பெண்ணுக்கு சொத்துரிமை கொடுக்கவில்லை என்ற நிலை இருந்ததாகக் கூறுகிறார். ஆனாலும், குரானுக்கு எதிராக ஒரு வழக்கம் (custom) இருக்குமானால், அது செல்லாது என்பது குரானில் சொல்லி உள்ளது. ஆனாலும், அவர் ஒரு முடிவுக்க வருகிறார். “ஒரு வழக்கத்தை, கிழக்கத்திய நாட்டினர் (பிரிட்டீஸ் அல்லாதவர்) தொடர்ந்து கடைப்பிடிக்கப் பட்டு வந்தால், பிரிட்டீஸ் கோர்ட் ஆப் ஜஸ்டிஸ் அதை ஏற்றுக் கொள்கிறது” என்கிறார். ஆனால் அது சட்டத்தை மீறியதாக இருக்க கூடாது என்கிறார். எனவே அந்த வழக்கில் ஒரு முகமதியப் பெண், சொத்துரிமை கேட்பதை மறுத்து விடுகிறார். அவ்வாறு பெண்களுக்கு சொத்துரிமை இல்லாமல், கச்சு மேமன், கோசாஸ் மக்களிடம் இருக்கும் வழக்கமானது பல காலமாக பின்பற்றி வரும் வழக்கம் என்பதால், அதை மறுக்கிறார். 

மற்றொரு வழக்கான Gangbai vs Tavar Mulla, 1 BHCR 71 என்ற வழக்கில், ஒரு கோஸா முகமதியப் பெண் தனது சொத்துக்களை சாரிட்டியாக (தர்மமாக) தனது உயிலில் எழுதி வைத்ததை சட்டப்படி செல்லாது எனத் தீர்ப்பு கூறி உள்ளது. தலைமை நீதிபதி Sausse CJ தனது தீர்ப்பில், “கோஜா சாதியினர், முகமதிய மதத்தை பின்பற்றி வந்தாலும், சொத்துரிமையைப் பொருத்து அவர்கள் இந்து மதச் சொத்து வாரிசுரிமையையே பின்பற்றி வந்துள்ளனர்” என்று குறிப்பிடுகிறார். 

மற்றொரு வழக்கான, Mulbai BHCR 276 page 284 என்ற வழக்கில், 1866-ல் கூறியுள்ள தீர்ப்பில், ஒரு கோஷா பெண்மணி வாரிசு இல்லாமல் இறந்து விடுகிறார். அவரின் சொத்துக்களை நிர்வகிக்கும் உரிமையை அவளின் சகோதரன், கோர்ட்டில் Letters of Administration கேட்கிறார். அதில், அந்த இறந்த பெண்மணி, அந்த சொத்தை, அவளின் இறந்த கணவரிடமிருந்து வாரிசாகப் பெற்று இருப்பதால், அவளின் இறப்புக்குப் பின்னர் அந்தச் சொத்து அவளின் கணவரின் வாரிசுகளையே சேரும் என்றும், அவளின் உறவுகளான அவளின் சகோதரனுக்குப் போகாது என்றும் தீர்ப்பு உள்ளது. இது குரானுக்கு எதிரானதாக இருந்த போதும், தொடர் பழக்க வழக்கத்தின் அடிப்படையில் இருப்பதால், அதுவும் சட்டத்துக்கு புறம்பாக இல்லாததால் கோர்ட் அதை ஏற்கிறது என்று சொல்லி உள்ளது. 

எனவே, கோசாஸ் இனத்தவர், இந்து சட்ட திட்டங்களின்படி நடந்து கொள்கிறார்கள் என்று ஏற்க முடியாது. ஆனால், அவர்கள் தானாகவே ஒரு பழக்க வழக்கத்தை ஏற்படுத்தி அதன்படி நடந்து வருகின்றனர். எனவே அவர்களை இந்துக்கள் என்றோ, இந்து சட்டப்படி நடக்கின்றனர் என்றோ எடுத்துக் கொள்ள முடியாது. கோசாஸ் இன மக்கள், இந்துக்கள் கடைப்பிடிக்கும் நடை முறைகளை, அவர்களும் கடைப்பிடிக்கிறார்கள் அவ்வளவே. மற்ற விஷயங்களில் அவர்கள் முகமதியர்களாகவே இருந்து வருகின்றனர். 

மற்றொரு வழக்கான Shivaji Hasam vs Datu Mavji Kohja 12 BHCR 281 pp.202 என்ற வழக்கானது 1847-ல் நடந்த வழக்கு. இதில், பழக்க வழக்கத்தை நிரூபிக்க போதிய சாட்சியம் இல்லை என்றாலும், அவர்கள்/ கோஸா முகமதியர்கள், இந்துக்களின் பழக்க வழக்கத்தை அடிப்படையாகக் கொண்டு, சொத்துரிமை வைத்துள்ளனர் என்றே எடுத்துக் கொள்ள வேண்டும் என்று தீர்ப்புச் சொல்லி உள்ளனர். கோஸா முகமதிய குடும்பத்தில் மூன்று சகோதரர்கள் இருக்க, அதில் மூத்தவர் மற்றவர்களுக்கு கார்டியனாக இருந்தது செல்லும் என்று சொல்லி உள்ளது. இது இந்து முறைப்படியான கூட்டுக் குடும்பத்தில் அவ்வாறு மூத்தவர் குடும்பத் தலைவராக இருப்பார் என்பதை ஒத்து இருக்கிறது. 
எனவே மதராஸ் பிரசிடென்சியில் அதுவரை கோர்ட்டுகள், கோஸா முகதியர்கள், இந்து வாரிசு உரிமை முறையை பின்பற்றி அதே போன்ற பழக்க வழக்கத்தை கொண்டிருப்பதை ஏற்றுக் கொண்டிருக்கின்றனர். 

மற்றொரு வழக்கான Rahimbhai Allubhai Hirabhai vs Gorbai, 12 BHCR 294 at page 304, என்ற வழக்கு 1875-ல் நடந்த வழக்கு. இதில், ஒரு கோஸா வியாபாரி சொத்துக்களை விட்டு விட்டு இறந்து விட்டார். அவருக்கு ஒரு மனைவி, தாய், மற்றும் திருமணம் ஆன ஒரு சகோதரி இருந்தனர். தீர்ப்பில், கோஸா பழக்க வழக்கப்படி, தாய் இந்த சொத்துக்களை நிர்வகிக்கும் பொறுப்பை பெறுவார் என்றும், அவர், இறந்தவரின் மனைவி, சகோதரி, இவர்களை விடவும் முன்னுரிமை பெற்றவர் என்றும் தீர்ப்பு உள்ளது. 

மற்றொரு வழக்கான Rahmatbai vs Hirbai, 3 B.34 : Ind. Dec.(N.S.) 23 என்ற வழக்கில் தீர்ப்பு 1877-ல் வந்தது. அதில், குழந்தை இல்லாமல் இறந்த கோஸா முகமதியருக்கு, அவரின் விதவை மனைவி, மற்றும் சகோதரி வாரிசாக வர முடியுமா என்ற கேள்வி எழுகிறது. அதில், பழக்க வழக்கம் ஏதும் இல்லாதபோது, இந்து வாரிசு உரிமையை இங்கு கொண்டு வரலாமா என்ற கேள்வி எழுந்தது.
